The investment group behind Interceptor Entertainment, SDN Invest, has announced that they have acquired Apogee/3D Realms, the developer/publisher responsible for franchises likeDuke Nukem,Commander KeenandRise of the Triad. The acquisition comes in the midst of anongoing disputebetween Interceptor and Gearbox Software over an as-yet unannouncedDuke Nukemtitle believed to be in development at Interceptor.

Speaking toEurogamertoday, new 3D Realms CEO Mike Nielsen shed some light on plans for the company going forward. 3D Realms will operate as a publishing arm, handling releases developed by Interceptor, both using existing intellectual property acquired as part of the purchase and developing new properties.

As for the lawsuit against Interceptor? Nielsen seemed unfazed, saying, “Our only message is we’re not all out of gum yet.”
